URGENT GRC Update for All NPA Members in Texas: Text Messages Covered under Texas’ Telephone Solicitation Law Effective September 1, 2025

The NPA learned yesterday that the Texas legislature amended laws to include text messages under its Do-Not-Call-List law and its Telephone Solicitation Law, effective September 1, 2025. These changes were enacted last week. 

 

The new laws make text messages the same as unsolicited telephone calls for most purposes.  The laws added a registration requirement for telephone solicitors, a registration fee of $200 and a private right of action for consumers who receive unsolicited text messages from telemarketers, a term that looks like it will include pawnbrokers. The changes apply to every customer or prospect you may have, not only to consumers who have registered their telephone numbers with a Do-Not-Call Registry in Texas or the federal Do-Not-Call Registry, as well. The new laws apply to solicitation calls and texts to or from Texas so the reach of these laws is broader than we may imagine. 

 

We are studying the changes and should have a better idea of how the changes affect your businesses shortly.

 

While we map out the changes, we recommend that you STOP SENDING any text messages to customers in Texas or from your store locations in Texas and call your local lawyer. 

 

So, watch for more information about the new Texas laws and talk to your local lawyer about the new Texas registration requirements, fees, and other features of these new laws as soon as you can.
